1 Introduction

1.1 The purpose of this standard is to define a series of procedures for certification bodies (non-governmental) to consider when deciding how to deal with the following situations: a) reports that a mark of conformity issued by the certification body has been misused\ or b) the certified product is subsequently found to be hazardous2. The action taken by the certification body will depend on the specific circumstances. For example, the relevant legal provisions on misuse of the mark of conformity; the nature of the contract or agreement between the certification body and the organization that misused the mark; the severity of the misuse; whether the misuse was accidental or intentional; whether the product is hazardous. . There are two distinct situations in which a manufacturer or seller of a product may be in a misuse of a mark, namely as a misuser or as a discoverer of a product bearing the mark that is subsequently found to be hazardous. www.bzxz.net
It is more difficult to foresee all potential forms of misuse or any other forms of use that may cause the product bearing the mark to become hazardous than to prevent obvious and common forms of misuse. The hazards caused by these different situations all require corrective measures, but the assessment of liability in each case requires completely different considerations. When deciding what corrective measures to take, the certification body must consider the issues of mass production and sales of products, protect the credibility of its mark, help people who are misled by the misuse of the mark, and treat competitors using the mark equally. In general, the corrective measures described in this standard require the following prerequisites:
--The certification system includes the use of the conformity mark, which is used on each certified product. A certification body has its own registered conformity mark or at least the use of its mark is protected by the law of the country where the certification body is headquartered.
--A contract or legally binding agreement on the use or misuse of the conformity mark is signed between the certification body and the party authorized to use the mark.
--The party authorized to use the mark has the ability to exercise continuous control over the certified products to ensure that all terms of the contract or agreement are met. 1.2 Where the mark of conformity is falsified or used without any contract or agreement, the certification body shall normally take strong corrective action. Such action shall be in accordance with the relevant provisions of national law on falsification and misuse of the mark. 2 Terms and definitions
