1 Scope
This part of GB/T 40094 specifies the transaction participants, transaction data, transaction methods, transaction procedures and rules, and dispute resolution rules in e-commerce data transactions.
GB/T 40094.1 applies to the activities and behaviors of data transaction business carried out by data transaction platforms under the e-commerce model.

This part of GB/T40094 specifies the transaction participants, transaction data, transaction methods, transaction procedures and rules, and dispute resolution rules in e-commerce data transactions.

3.1 Terms and definitions

Data data

An organization or individual that conducts data transactions on the e-commerce data transaction platform. 3.1.4
Data supplier
In e-commerce data transactions, a transaction subject that owns the data or obtains part or all of the rights and interests of the data owner through legal authorization to provide transaction data to the platform.

API: Application Programming Interface 4 Transaction Participants
4.1 Basic Requirements
4.1.1 Transaction participants mainly include e-commerce data transaction platform operators (hereinafter referred to as "platform operators"), transaction entities and payment service providers:
4.1.2 Platform operators provide transaction entities with transaction, financial, information and other services that are consistent with data transactions, supervise the behavior of other transaction participants, and ensure transaction security, reliability and fairness. 4.1.3 Transactions participating in data transactions The payment service provider shall be qualified by the platform operator and sign a contract with the platform operator to clarify the relationship and rights and obligations.
4.1.4 The payment service provider shall cooperate with the platform operator to provide financial services and be responsible for supervising and guaranteeing the flow of funds for data transactions as required by the contract.
4.2 Trading platform operator
4.2.1 Qualifications and operating conditions
The qualifications and operating conditions of the platform operator shall comply with the provisions of 5.1 of GB/T31524-2015 and shall also meet the following conditions, including but not limited to:
a) Have the ability to provide data circulation and transactions a) The ability to provide premises, facilities and services; b) Engage in data transactions that are subject to national laws, regulations or relevant department regulations and obtain relevant licenses. 4.2.2 Platform operation technical requirements
The trading platform provided by the platform operator must meet the following requirements, including but not limited to:) The platform operation technology complies with the relevant provisions of Chapter 10 of GB/T315242015: 6) Other technical requirements comply with national laws, regulations and national standards. 4.2.3 Transaction subject qualification review
The platform operator reviews the transaction subject qualifications to meet the following requirements, including but not limited to: a) The platform operation technology complies with the relevant provisions of Chapter 10 of GB/T315242015: d) Other technical requirements comply with national laws, regulations and national standards. ) The qualifications of the transaction subject should be verified, registered and filed, and reviewed regularly or irregularly. The verification materials include but are not limited to identity documents, business licenses and administrative permits, etc.: b) "A verification and filing system for the qualifications of the transaction subject can be formulated in accordance with the requirements of national laws and regulations or relevant national standards to clarify the qualification requirements and review content, etc., or it can be verified in accordance with the relevant provisions of (13/35109-2017). 2

4.2.4 Supervision and management of the transaction process
Platform operators have supervision and management responsibilities in data transactions, including but not limited to: GB/T 40094.1—2021
a) A platform service agreement and transaction rules should be formulated to clarify the rights and obligations in terms of entering and exiting the platform, data quality assurance, protection of the rights and interests of transaction subjects, and protection of personal information; b) An information release system should be established to publish transaction data and relevant information of transaction subjects to ensure the authenticity and accuracy of the information; the transaction data released by the platform should comply with the provisions of national laws and regulations, and the data that violates the regulations should be cancelled and reported to the relevant competent authorities; )
Measures should be taken to ensure the integrity and security of relevant information generated in transaction activities; national laws, regulations and relevant national standards should be observed to ensure the legality and security of the transaction process; e)
3 Transaction subjects
The subjects participating in data transactions shall meet the following requirements, including but not limited to: a) obtain relevant qualifications, undergo registration review, and be able to independently bear economic and legal responsibilities; b) provide qualification review materials as required. The materials shall comply with the provisions of 4.1.2 of GB/T35409-2017; comply with national laws and regulations and relevant platform regulations. Ensure that the transaction behavior is legal and compliant; d) Ensure that the information of transaction data is accurately and timely released; ensure the quality of transaction data and meet the standards for data quality; ensure the security of transaction data storage, transmission and use, and the relevant data security management can be implemented in accordance with relevant national standards; g) accept the management and supervision of the platform and cooperate with the work of the platform. 4.4
Payment service provider
The requirements for payment service providers shall comply with the relevant provisions of Chapter 8 of (13/T315242015). 5 Transaction data
The transaction data specified in this part is the original or processed digital information. The transaction data shall meet the following requirements, including but not limited to:
a) Comply with the provisions of national laws and regulations, and do not involve privacy information protected by laws and regulations and data that is explicitly prohibited from trading by laws and regulations;
b) Obtained through legal channels. The rights to the data are clear and undisputed: Comply with the provisions on data quality in IS08000 (all parts), G13/T36073 and (G3/T36344); l) The data itself is consistent with the data description information of the platform, Comply with the requirements of GB/T40094.2-2021. 6 Trading methods
The data trading methods that the platform can provide include but are not limited to: a) Data packet trading. The data provider transfers or copies the data to the platform, and the platform provides the purchased data to the data demander.
b) API data trading. The transaction form in which the data provider provides the purchased data to the data demander in the form of API data call interface.
c) Custodial data trading, the data provider transfers or copies the data to the platform, and the data demander uses the data within the territory provided by the platform, and the original data is not transferred.3

7 Trading procedures and rules
7.1 Basic requirements
7.1.1 The platform should agree on specific trading procedures, formulate corresponding management measures, and publicly represent all trading entities. 7.1.2 The transaction parties reach a contract through a certain transaction method, exchange data and price as agreed, and settle according to regulations.
7.1.3 The transaction procedures include but are not limited to data registration, data verification, transaction implementation and transaction settlement. 7.2 Data Registration
The data provider completes the data registration process through the functional entrance provided by the platform. Data registration requirements include but are not limited to: a) The data provider guarantees that the registration information of the data is accurate, true and complete; b) The data provider should have the right to determine the data price independently, or in accordance with the pricing method agreed with the platform and entrust a third-party agency to conduct a price assessment and other methods:

7.3 Data Review
The platform completes the legality review process of the data. The data review requirements include but are not limited to: a) The platform should publish the data review management system and clarify the content and basis of the review: b) The data should be reviewed to see if it involves privacy information or data prohibited from being released or transmitted by national laws and regulations; c) Data that has passed the review can be published on the platform; d) Data that has not passed the review has the right to require the data provider to make corrections. 7.4 Transaction Implementation
The data provider and the data demander reach a contract and complete the process of payment and data delivery: The transaction implementation requirements include but are not limited to:
a) The contract is established after the data demander selects data that meets the offer conditions and completes the data price payment; the data demander can complete the data price payment through the payment service provider, or use other methods negotiated with the data provider. h)
Payment:
The data provider shall deliver data to the data demander in strict accordance with the contract regulations and ensure that the delivered data is consistent with the data purchased by the data demander;
d) The two transaction entities ensure the security of the data delivery process. 7.5 Transaction Settlement
After the data demander completes the data download, call or use rights or the data delivery period ends, the data provider and the payment service provider complete the settlement process. The transaction settlement requirements include but are not limited to: a) The data demander completes the data download, call or use rights within the specified period; h) The data provider shall complete the data price settlement in accordance with the contract; c) The payment service provider shall provide settlement services to the data provider in accordance with the contract: -iiKaeerkAca-
Dispute handling rules
Dispute handling requirements in data transactions include but are not limited to: GB/T40094.1—2021
a): The platform should establish a dispute handling mechanism. a) Formulate and publicize dispute handling rules, and resolve disputes fairly and impartially based on the principle of free will; b) The platform shall establish a convenient and effective complaint and reporting mechanism, publicize information such as complaint and reporting methods, and promptly accept and handle complaints and reports;
When a dispute occurs, the transaction entity may resolve it through negotiation and settlement, requesting a consumer protection organization or other legally written mediation procedures, complaining to the relevant department, requesting arbitration, or filing a lawsuit; When a dispute occurs, the platform shall actively assist in evidence collection and coordination to resolve it, and safeguard the legitimate rights and interests of the transaction entities; d)
In the process of dispute resolution, the platform shall provide the original contract or transaction record; If the relevant information is lost, forged, altered, destroyed or concealed due to the platform's reasons, the platform shall bear the corresponding responsibility. 5

The process of reaching a contract between the data provider and the data demander, completing the payment of the price and data delivery: The transaction implementation requirements include but are not limited to:
a) The data demander selects data that meets the offer conditions and completes the payment of the data price. The contract is established; the data demander can The payment of data price is completed through the payment service provider, and other methods negotiated with the data provider can also be used. h)
Payment:

Set up processing rules The dispute resolution requirements in data transactions include but are not limited to: GB/T40094.1—2021 a): The platform should establish a dispute resolution mechanism, formulate and publicize dispute resolution rules, and resolve disputes fairly and impartially based on the principle of free will; b) The platform should establish a convenient and effective complaint and reporting mechanism, disclose information such as complaint and reporting methods, and promptly accept and handle complaints and reports; When a dispute occurs, the transaction entity may resolve it through negotiation and settlement, requesting a consumer arbitration agreement or other legally written mediation procedures, complaining to relevant departments, requesting arbitration, or filing a lawsuit; When a dispute occurs, the platform should actively assist in evidence collection and coordination to resolve it, and safeguard the legitimate rights and interests of the transaction subject; d) In the dispute resolution process, the platform should provide the original contract or transaction record; If the relevant information is lost, forged, altered, destroyed or concealed due to the platform, the platform shall bear the corresponding responsibility. 5
